Department of Insurance: On Friday Sept 19, 2014 Allstate appraiser Tim Luddy signed in at our repair facility at 11:00 to inspect additional damages to our customer's vehicle. I greeted Mr. Luddy and we shook hands. We walked back to where the vehicle was waiting and I handed him our repair order and reconciliation report that showed him our additional repair items that were missed during Allstate's initial inspection. We discussed several items until Mr. Luddy began to tell me how the vehicle was to be repaired. I explained that his job was to settle the claim and identify the items not written on Allstate's estimate that we showed him on our repair order. It is significant to state, Allstate's position on this claim is the liability carrier without any insurance policy guidelines to permit such behavior. Due to Allstate's accepting the liability and obligation for a pre-accident repair Mr. Luddy is in no position to dictate insurance policy contract language or conditions against this claim. After inspecting the vehicle in its dismantled condition I showed Mr. Luddy back to the front of our building where his vehicle was parked. I went into our facility and continue my day as Mr. Luddy sat in his vehicle working on his computer. At 12:00PM Mr. Luddy walked into our front office signed out and placed a check on our counter with a copy of his estimate. He walked out of facility without mentioning any discrepancies or attempting to discuss his estimate with me. Pa State Consumers Protection Laws protect consumers against appraisers forcing a take it or leave situation and this claim must be investigated. As per the Pa Motors Physical Damage Appraiser Law and Regulation " The Apprasier Must (3) Review the appraisal with an authorized representative of the repair shop which is selected by the consumer or with any other person reasonably necessary to demonstrate that the actual costs of repairs are adequately covered in the appraisal. Mr. Luddy's written estimate was significantly different then our repair order forcing us to stop the repair process and contact Allstate to send out and appraiser for another inspection. Please investigate the manner in which Allstate Insurance Company is handling claims and file a violation against Mr. Tim Luddy for his unprofessional behavior and poor market conduct.
